Short term rentals via digital platforms are governed by a comprehensive legal framework in Morocco, Justice Minister Abdellatif Ouahbi said, citing existing laws covering electronic contracts and tourist accommodation.
In a written response to a parliamentary question, Ouahbi said Moroccan legislation has anticipated the growth of online rentals by recognizing the legal validity of electronic contracts under Law 53.05 on electronic data exchange, adopted in 2007.
The law establishes legal equivalence between digital and paper documents and allows electronic contracts to serve as proof.
He added that Law 43.20, in force since 2020, further regulates electronic trust services, including digital signatures, certification and data security, under the supervision of the National Directorate for Information Systems Security.
Ouahbi noted that short term rentals are also subject to tourism law, notably Law 80.14 and its 2023 implementing decree, which require administrative authorization, mandatory insurance, safety standards and daily electronic reporting of guests. Violations are subject to fines and administrative sanctions, he said.
