The Club des Avocats au Maroc has formally challenged the Confederation of African Football (CAF) regarding circular GS/2025/03/001, which impacts the approval of RS Berkane’s kit. The legal organization argues that this decision raises serious governance and legal concerns.
At the heart of the dispute lies a ruling by the Court of Arbitration for Sport (CAS) in case TAS 2024/A/10528, which validated RS Berkane’s kit approval on October 14, 2023. This ruling was upheld by CAF’s Appeals Jury, ensuring the club’s eligibility in the 2023/2024 Confederation Cup.
The lawyers warn that applying the circular retroactively would violate the fundamental principle of non-retroactivity under international law. They urge CAF to uphold the kit’s approval for the 2024–2025 season and prevent legal uncertainties that could compromise fair competition.
