Morocco has allowed cannabis use for over a year, after the implementation of law 13.21 legalizing the plant’s different uses, while extracting THC.

Article 6 of this law stipulates that the authorization of cultivation and production of cannabis with a psychoactive substance content of
tetrahydrocannabinol (THC) may be granted only to the medical and pharmaceutical industries.

Six new implementing decrees were published earlier this month in the Official Bulletin (BO), detailing the steps to follow in order to plant cannabis.

Article 7 of law 13.21

In order to obtain the authorization for the culture and production of cannabis, it is necessary to provide a file justifying that the applicant for the authorization meets the following conditions:

– To be of Moroccan nationality.
– To be aged over 18 (legal age).
– To reside in one of the douars of one of the provinces authorized to cultivate cannabis, being Al Houceima, Chefchaouen, and Taounat.
– Be a member of one of the cooperatives, specifically created for the purpose of commercializing cannabis.

– Be the owner of the plot of land necessary for this purpose, or have an agreement of a land owner to cultivate cannabis or have a certificate issued by the local administrative authority to cultivate the plant.

The application for a license to process and manufacture cannabis and its derivative products must, when filed, include the following documents:

-An application dated and signed by the legal representative of the license applicant.

-Status of the applicant.

-An explanatory note indicating the human and financial resources available to the licensed applicant to carry out its activity, together with the organizational chart and resumes of the applicant.

-An obligation to honor the significance of the sales contract, as provided for in article 10, law no. 13.21.

Article 8

The authorized growers and producers must :

– comply with the requirements of the specifications established by the Agency (ANRARC) in coordination with the government authorities concerned;
– Use the seeds and plants certified by the Agency in accordance with the terms and conditions established by regulation;
– Deliver the entire crop to the cooperatives referred to in Article 7 for the price fixed in the sales contract.

The specifications must include :

– Standards to respect for the cultivation and production of cannabis ;
– Rules relating to the crop rotation including the number of agricultural cycles allowed;
– The technical standards related to the use of fertilizers and pesticides, subject to applicable laws and regulations in force.

According to article 24 of the same law, ANRARC may require the applicant to provide, within the fixed deadline, which may not be less than 10 days from the date of receipt, any additional information it deems useful in order to decide on the application.
