Morocco’s Treasury grants notaries and adouls access to digital property tax clearance system

Morocco’s General Treasury has responded positively to a request from the National Association of Adouls, granting them continued access to the digital platform used to issue property tax clearance certificates, a crucial document required for property transactions.

The Treasury’s decision, outlined in an official response viewed by Hespress AR, comes after similar correspondence from the National Council of Notaries, both calling for clarity and access to the updated system.

The certificates, which confirm that a property is free of outstanding local taxes and fees, have become central since the implementation of Law No. 25-14 on June 12, which amended the law governing local government taxation.

In its response, the Treasury emphasized that adouls, like notaries, can continue using the electronic platform via the Treasury’s portal. The system, in use since November 1, 2020, allows legal professionals to submit digital requests and receive clearance certificates issued by public accountants.

The platform streamlines the exchange of tax information and removes the need for physical document submission, in line with the joint circular issued in 2020 by the Treasury and the Directorate General for Local Authorities.

The Treasury also confirmed that adouls can access a taxpayer information card issued by the General Directorate of Taxes through the same platform to support their applications. This move aims to reduce the backlog of clearance requests that have built up since the revised law took effect.

In a separate development, the Treasury disclosed that on June 17, it transferred critical tax data, including housing tax and communal service fees, to the tax administration to facilitate assessment and collection. The tax authority then formally requested, on June 23, that the Treasury continue issuing clearance certificates in digital format. The request was granted on June 26.

The Treasury also agreed to include the new taxpayer information card among the required documents for clearance applications. Additionally, it accepted a request from the notaries’ council to incorporate housing and service tax queries, known as TH-TSC,  into the Treasury’s digital platform, “TGR,” in coordination with the “Tawthiq+” system used by legal professionals.

However, the Treasury conditioned this integration on receiving a detailed technical outline of the data-sharing process.

The developments follow a July 1 letter from the president of the notaries’ council to the Treasury, the tax directorate, and the Directorate of Local Finance at the Ministry of Interior. The letter urged full enforcement of the June 16 joint circular, which mandated the complete digitization of the property clearance process and the abolition of all paper-based transactions.

These reforms come as part of Morocco’s broader push to modernize public administration, improve efficiency, and ensure transparency in real estate and tax procedures, a shift welcomed by legal professionals navigating increasingly complex property documentation requirements.
