Major tax probe launched into prominent Moroccan real estate developers

A significant tax investigation is underway targeting several high-profile real estate developers in Morocco, particularly focusing on projects in Casablanca and Marrakech.

According to exclusive information obtained by Hespress Ar, these developers have come under intense scrutiny since the beginning of the year amid allegations of widespread tax evasion and fraud. Tax inspectors have identified substantial discrepancies in remote tax declarations, prompting on-site audits of specific real estate companies.

The investigation has drawn on evidence from lawsuits filed against these developers, which allege fraud and embezzlement involving construction and equipment suppliers. A comparative analysis of this information with the companies’ accounting records has revealed troubling patterns of income underreporting.

Many developers are reportedly understating the value of construction work on their projects and manipulating invoices and payment vouchers. Contractors have also reported being pressured to accept lower payments, with some even having their equipment seized to recover unpaid debts.

Complaints have surfaced regarding practices known locally as noir, which refers to black market dealings, with allegations that developers are using a network of subcontractors to evade taxes. Tax inspectors have cross-referenced financial data with information from other government agencies to verify the financial status of these companies and their executives.

Discrepancies have emerged between declared financial statements and property transfers, including the acquisition of luxury vehicles at inflated prices. Developers appear to have inflated expenses while underreporting profits to mislead tax authorities.

The scope of the investigation has broadened to include the sales of residential units, as authorities have uncovered widespread tax evasion related to capital gains from property sales. Developers are accused of circumventing taxes on advance payments for residential units, particularly in Casablanca, Marrakech, and Tangier.

Confronted with potential substantial tax liabilities, many developers are seeking legal counsel to negotiate settlements with tax authorities. Some, involved in projects with public entities and partnerships with major banks, are particularly eager to reach amicable agreements.
