14 members of the outgoing government won parliamentary seats in the September 23 elections, but they cannot legally hold both positions at the same time.
Article 27 of the House of Representatives’ internal rules stipulates that “membership in the House is incompatible with serving as a government member.”
MPs who are in a situation of incompatibility, the article reads, must inform the House Bureau of any status that conflicts with their membership in the House of Representatives.
The list includes ministers and other senior figures from the three parties that formed the government coalition for 2021-2026, starting with the Authenticity and Modernity Party (PAM), which finished first in the September 23 elections with 97 seats.
Among them are Justice Minister Abdellatif Ouahbi, who won a seat in Taroudant Al Chamalia, and Minister of National Territorial Planning, Land Planning, Housing, and City Policy Fatima-Zahra Mansouri, who won in Marrakech’s Sidi Youssef Ben Ali constituency.
Youth, Culture, and Communication Minister Mohamed Mehdi Bensaid won in Rabat-Ocean, while Higher Education, Scientific Research, and Innovation Minister Azzeddine El Midaoui won in Rhamna.
The list also includes Housing Secretary of State Adib Benbrahim, who won in Rabat-Chellah, and Employment Secretary of State Hicham Sabiri, who won in Beni Mellal.
The National Rally of Independents (RNI), which secured 66 seats in the recent elections, placing it second, also has several officials who fall under the same legal provision.
These include government spokesperson Mustapha Baitas, who secured a seat in Sidi Ifni, and Agriculture, Fisheries, Rural Development, and Water and Forests Minister Ahmed El Bouari, who won in the Ouazzane constituency.
The list also includes Social Economy and Solidarity Secretary of State Lahcen Saadi, who won in Taroudant Al Chamalia, and Maritime Fisheries Secretary of State Zakia Driouech, who won a seat on the regional list in Souss-Massa.
The Istiqlal Party, which claims it secured 66 seats in its provisional tally, also has several officials among the newly elected MPs whose government positions are incompatible with their parliamentary seats.
These include Equipment and Water Minister Nizar Baraka, who secured a seat in Laraache, Transport and Logistics Minister Abdessamad Kayouh, who won in Taroudant Al Janoubia, Industry Minister Ryad Mezzour, who won a seat in Benslimane, and Foreign Trade Secretary of State Omar Hejira, who won in Oujda-Angad.
