Morocco must submit its defense and objections to jurisdiction by January 2027 in a $1.215 billion arbitration over Emmerson PLC’s stalled Khemisset potash project.
The International Centre for Settlement of Investment Disputes tribunal has scheduled a hearing for July 17-26, 2028, Emmerson said Tuesday.
The timetable follows the tribunal’s July rejection of Morocco’s request to examine jurisdiction separately before considering the merits. The ruling did not reject Morocco’s jurisdictional objections, which will instead be assessed alongside the underlying dispute.
Emmerson must respond to Morocco’s counter-memorial by October 2027, followed by Morocco’s rejoinder in January 2028.
Emmerson subsidiaries Khemisset UK Ltd. and Potasse de Khemisset SA seek $1.215 billion, net of taxes and including interest. They allege Morocco expropriated the project and breached fair-treatment, protection and nondiscrimination obligations under the 1999 UK-Morocco investment treaty.
