Morocco ministry cites complex coordination for water management law delays

Morocco has yet to finalize several implementing decrees linked to its water law due to coordination challenges involving multiple institutions and government departments, an official at the Ministry of Equipment and Water told Hespress.

The official said preparing the regulatory texts required technical studies and consultations among several ministries and public agencies before they could be submitted to the government council for approval.

Morocco’s Cour des comptes said in its latest annual report that nine implementing decrees tied to Law 36.15 on water management remain pending, including key rules governing desalination concession contracts and the reuse of treated wastewater.

The ministry official said delays affecting implementing decrees are not unique to the water law and occur in several sectors because of the technical and legal work required before regulations can be adopted.

Draft texts typically go through several stages, including the preparation of an initial version, revisions, and consultations with other government departments that may propose amendments or technical adjustments, the official said.

Some provisions require additional legal and technical analysis or coordination with international cooperation frameworks, which can extend the drafting process.

The official also said recent climate related developments, including flooding events, prompted authorities to review some provisions related to dam safety and classification before issuing the corresponding decrees.

“These texts must be carefully prepared so they do not require revision shortly after adoption,” the official said.
He added that the ministry continues to oversee dam management under its existing legal authority while working to finalize the remaining regulatory framework.

The decrees are expected to clarify coordination mechanisms, information sharing and administrative procedures among the various institutions involved in water infrastructure management, including dams.
