A UK-based potash exploration company, Emmerson Plc, has initiated arbitration proceedings against Morocco, seeking $2.2 billion in damages over alleged expropriation of its Khemisset potash project.
The claim was filed with the International Centre for Settlement of Investment Disputes (ICSID), part of the World Bank, under the UK-Morocco Bilateral Investment Treaty signed in 1990 and effective since 2002.
CEO Graham Clarke described the submission, announced on May 1, as a critical step marking the formal start of legal proceedings.
Emmerson alleges Morocco unlawfully blocked its $2.2 billion project, notably after the Regional Investment Commission rejected the project’s environmental impact assessment in late 2024, citing excessive water use.
The process is expected to last about two years.
