Morocco moves to regulate electric scooters in traffic code update

Morocco has taken a major step toward integrating electric scooters into its Traffic Code with a draft amendment to Law No. 52.05, introduced by the Ministry of Transport and Logistics. The proposal, now open for public consultation through the General Secretariat of the Government, seeks to establish new traffic violations and regulations for electric scooter users.

The draft law outlines several infractions aimed at enhancing road safety. Among the key violations included in Article 1:

  • Failure to wear an approved protective helmet when riding a motorized bicycle, motorcycle, three-wheeled, or four-wheeled motorbike without a chassis.
  • Ignoring stop signs or red traffic lights.
  • Using a handheld mobile phone or similar electronic device while operating a vehicle.

The proposal also introduces new classifications for electric mobility devices. Under the revised law, a pedal-assist bicycle is defined as: “A bicycle with at least two wheels, equipped with an auxiliary electric motor of 250 watts or less, which automatically cuts power when the rider stops pedaling or gradually ceases operation before reaching 25 km/h.”

Additionally, a category for personal motorized transportation devices has been added, describing: “A motorized vehicle without a seat, designed for a single user, lacking cargo capabilities, equipped with handlebars, and powered by a non-combustion motor or electric assistance system, with a top speed of 6 to 25 km/h.”

The amendment also strengthens enforcement measures, granting police officers the power to impound vehicles in certain situations. For example, any vehicle operating on highways that cannot reach 60 km/h may be seized and taken to an impound lot.

Authorities argue that the update is necessary to address safety concerns and technological advancements in electric mobility. A government statement accompanying the proposal noted: “A decade of enforcement under the current Traffic Code has revealed gaps and inconsistencies that require correction. Additionally, rapid technological advancements have introduced new mobility devices, some of which pose safety risks, while others contribute to improving road safety. This necessitates a critical reassessment of traffic laws.”

By including electric scooters and other personal transportation devices in the Traffic Code, Morocco aims to clarify legal responsibilities, enhance safety, and adapt regulations to modern mobility trends.
