Ouahbi confirms retroactive application of alternative sentences law

Morocco’s new alternative sentences law, which took effect last month, can apply not only to newly convicted prisoners but also to those whose sentences were finalized before the law’s implementation, Justice Minister Abdellatif Ouahbi confirmed.

Ouahbi told Hespress that the legislation explicitly allows retroactive benefit for inmates, provided they meet the required conditions. “The law contemplates these cases and opens the possibility for those with final court rulings to request substitution of their remaining prison term with an alternative sentence,” he said.

Under Article 22-647 of the law, requests can be submitted to the sentencing court by the convicted individual, their legal counsel, a legal representative of a minor, or the prison director. Courts must rule on such requests within 15 days of filing.

The measure allows prisoners who have served part of their sentence to “buy out” the remaining days under the conditions specified in the law, offering a potential path for early release.
