The Government Council approved Thursday a draft decree concerning the Road Code, specifically addressing transactional and fixed fines, following various observations.

Presented by the Minister of Equipment and Water, Nizar Baraka, on behalf of the Minister of Transport and Logistics, Abdessamad Kayouh, the draft decree (2.24.655), amending decree 2.10.313 of September 29, 2010, focuses on the application of provisions in Law No. 52.05, which pertains to the Road Code, in relation to transactional and fixed fines.

The draft decree aims to align and update certain administrative procedures related to infractions under Law No. 52.05, as amended and supplemented by Law No. 116.14, along with the deadlines set by the aforementioned decree, as stated by Mustapha Baitas, the Minister Delegate for Relations with Parliament and government spokesperson, during a press conference following the Council meeting.

The proposed changes include defining the distance allowing offenders to retrieve their driver’s license, vehicle registration certificate, or vehicle ownership title from the competent authority responsible for enforcing infractions, either at their place of residence or the location where the fine was paid, in accordance with the fourth paragraph of Article 228 of the Road Code.

The text also grants the authority responsible for issuing fines the ability to seize the vehicle ownership title, similar to the way driver’s licenses and registration certificates are confiscated. The draft sets a 30-day period for returning the seized document upon payment, aiming to align with changes introduced by Law No. 116.14.

Additionally, the decree will be brought in line with Law No. 103.14, which established the National Road Safety Agency (NARSA), by replacing the Ministry with NARSA in references to the “administration” in Article 224, Paragraph 4, and Article 225, Paragraph 2, as well as Articles 227, 236, and 237 of the aforementioned Law 52.02.

Regarding the draft decree 2.23.1043 on maritime investigations into incidents involving fishing boats, Baitas clarified that the examination of this text has been postponed to add more substance to its content.
