The Economic, Social, and Environmental Council confirmed that “child marriage continues despite the legislative efforts made.”
In its annual report for 2023, released last Tuesday, the Council highlighted that setting the legal marriage age at 18 years, as stipulated by the Family Code in 2004, in contrast to the previous Personal Status Code (which allowed marriage at 15), “has not succeeded in eliminating this phenomenon due to the exception that allows judges, in certain isolated cases, to lower the marriage age.”
It is noted that the Ministry of Justice, through its oversight of amendments to the criminal law, is considering criminalizing the phenomenon of child marriage and punishing violators, as part of its efforts to combat this issue, which is considered a violation of children’s rights and threatens their health and development, according to the ministry.
