Morocco’s Economy and Finance Ministry said it has issued a decision to dematerialize the procedures of public deals by depositing the bidders and their offers, and launching them online.

In accordance with these provisions, issued in Resolution No. 1982.21 contained in the Official Gazette 7104, the maintenance and exploitation of the electronic database of contractors, suppliers and services will be determined.

The decision also specifies the conditions and modalities for resorting to and conducting electronic tenders, in addition to stripping financial guarantees of their physical character, and the methods for the enforcement of provisions related to electronic bidding and withdrawal of bidders’ envelopes and offers.

The decision indicates the necessity of electronic signature on each document from the competitor in accordance with the legislative and regulatory texts.

The envelopes of the competitors also have to be encrypted before being deposited through the portal, added the same source.

A generalization is awaited that bidders’ envelopes and offers must be deposited and withdrawn electronically, starting August 1, 2023.

The deposit of envelopes in a physical form will remain valid for transactions with an estimated price of less than MAD 5 million, according to the same source.
