Brazilian senate approves extradition treaty With Morocco

Brazil’s Senate has approved a legislative decree ratifying an extradition treaty with Morocco, signed in 2019, which sets the framework for the transfer of individuals wanted by justice or already convicted in either country, the Senate’s news agency reported.

The treaty establishes clear rules to ensure extraditions are carried out efficiently and in line with international law. Under its terms, individuals can only be tried for the specific crime cited in the extradition request, and the offense must be recognized as a crime in both countries’ legal systems.

Brazil’s foreign and justice ministries, when forwarding the treaty to Congress, said growing cross-border movement of people and goods makes stronger international cooperation essential for enforcing both Brazilian and foreign laws. They described the treaty as “comprehensive and detailed,” providing a secure and swift process for handling extradition requests.

Sen. Sergio Moro, of the União Brasil party representing Paraná state, said the agreement formalizes the use of extradition, one of the oldest tools of international criminal cooperation. He noted the treaty includes standard provisions such as dual criminality, the principle of specialty, mandatory and optional grounds for refusal, competing requests, and procedures for submission and surrender.

“This type of treaty is a fundamental tool for judicial cooperation and for building modern mechanisms to fight crime globally,” Moro said.

The treaty now paves the way for closer judicial collaboration between Brazil and Morocco, strengthening efforts against transnational crime.
